Duty to register in the territory of the CR
Following text will indicate main duties of an alien which relate to the registration and reporting the place of residence in the territory of the CR.
Aliens staying in the CR on visa are obliged within 3 working days to report the beginning of their stay, place of residence and an expected length of stay. If an alien is accommodated in a facility for which he/she pays (hotel, lodging-house), registration is done ex lege by the accommodation provider. If you are staying in the territory visa-free, you are obliged to report the beginning of your stay, place of residence and an expected length of stay not later than within 30 days.
Within the meaning of the Aliens Act accommodation provider is a person who accommodates more than 5 foreigners for consideration (unless they are close persons). As mentioned above, in such cases provider of accommodation fulfils the registration duty for aliens. Accommodation provider is obliged to keep a registration book of aliens accommodated; data contained in the book shall be reported by him/her to police within a defined period of time.
Alien’s duties
Apart from the duties indicated in the Aliens’ Act a foreigner has mainly the following duties:
- upon release from custody or jail he/she is obliged to report to alien police department,
if he/she has no travel document and visa (if these are needed);
- to prove his/her identity with valid passport or a residence permit card if requested by
police and prove that his/her stay in the territory is legitimate (e.g. with valid visa);
- to report to police a change of surname, personal status (marriage, divorce);
- to surrender the document issued by police, if its validity expired (with the exemption of
identity card and visa on which an alien traveled and entered the territory);
- to report to police a loss or theft of documents issued by police, or perhaps passport;
- to submit to such actions as taking fingerprints, video recording , medical examination
etc. as provided by law;
- if requested by police, to present adequate funds to sustain himself/herself.
Travel documents
Following documents will be accepted as travel documents in individual cases:
- official document which is recognized by the Czech Republic as travel document;
- official document proving the data on alien’s citizenship, his/her identity, data on the
validity of the document and an alien’s photograph, if such a document is an official
document issued by a foreign state;
- certificate of identity of an EU citizen;
- substitute travel document of the EU;
- list of students on a school trip within the EU which contains students’ photographs and
a certificate of a member state in which the student lives;
- alien’s passport;
- travel certificate of identity;
- travel document issued by the Czech Republic based on an international agreement.
The three documents mentioned above are issued by alien police upon request of a foreigner:
Alien’s passport is issued by alien police upon request of a foreigner who is staying in the CR on permanent residence permit, who has no valid travel document and who proves that he/she cannot obtain it in any other way. Alien’s passport can also be issued to an alien below the age of 15 who is staying in the CR based on the judgment of fosterage, or an alien who has no travel document and who is staying in the territory of the CR for the purpose of temporary protection.
Travel certificate of identity is issued by police upon request of a foreigner who has no travel document and who cannot obtain it in other way. Police will issue certificate of identity to an alien who has not a valid travel document and who did not apply for it in the following cases:
- after the annulment of short term visa;
- after a ruling on the annulment of long term visa or residence permit becomes effective;
- after the extinction of a right to permanent residence;
- after the termination of permanent protection;
- after the issuance of visa for the purpose of tolerated stay to a foreigner who cannot
leave the territory for reasons stipulated by law.
Travel certificate of identity shall be issued by police to an alien who has no valid travel document and whose expulsion was decided in the CR by final judgment.
