Long term residence permit for the purpose of protection in the territory

You can apply for this type of residence permit, if:

- you may be a victim of trafficking in human beings,

- a person for whom illegal crossing of the state border has been organized or who has been smuggled across the border and your testimony is significant for tracing down a perpetrator or an organized group who is involved in organizing illegal crossing of the state borders or in smuggling  people.

                This applies under the condition that you collaborate with law enforcement bodies in the criminal prosecution of a perpetrator who is suspicious of one of the above mentioned offences.

                Law enforcement body shall instruct you without delay about a possibility to apply for this type of residence permit, as well as about conditions which you need to satisfy to be granted such residence permit.  Such an instruction shall be conducted in a language in which you can make yourself understood. You are given one month from the date of the instruction to decide, if you want to collaborate with the law enforcement body. You cannot be expelled from the country during this protection period; nor can your stay in the country be terminated in a different way, however, protection period shall not be included in the duration of stay related to your potential previous expulsion.

                Application can be submitted at the Ministry of Interior of the CR.

 

                Requisites of the application:

travel document, even if its validity has expired,

document evidencing your lodging in the territory,

two photographs,

confirmation from a law enforcement body that conditions for filing a request for this type of residence have been satisfied.

If you are granted this type of residence permit for the purpose of employment, business or study, you are considered a foreigner with permanent residence permit.

Long term residence permit for the purpose of tolerated stay in the territory

                You can apply for this type of residence permit, if you have been issued visa for over 90 days for the purpose of tolerated stay, if your stay in the territory is going to exceed 1 year and if the grounds for issuing this visa are still valid.

                When applying for visa, you are obliged to submit your travel document (if you have one), a verified copy of a document confirming the existence of an obstacle which does not allow you to leave the country (or the declaration on word of honour), travel health insurance policy (in case of applying for permanent residence permit), document evidencing a lawsuit (in case that a lawsuit has been filed) and 2 photographs.

                The application is submitted at an alien police department relevant to your domicile.

Extension of the validity of long term residence permit

Long term residence permit can be repeatedly extended, however, its maximum validity period cannot exceed validity of the first long term residence permit depending on permitted purpose of stay.

 

                The application can be submitted at an alien police department relevant to your domicile.

                The application is submitted 120 days at the earliest and 14 days at the latest before the expiration of your initial long term residence permit. Exemptions are stipulated by law.

                Your application shall be cleared within 60 days from the date of its submission.

 

                Requisites of the application:

-  travel document

-  document evidencing the purpose of stay in the territory

-  document  proving sufficient funds to sustain yourself

-  document evidencing that you are provided with lodging during your stay in the territory

-  abstract from Criminal Register of the CR (this does not apply to persons under 15 years of age)

-  travel health insurance policy covering the duration of your stay in the territory

-  medical report indicating that you do not suffer from a serious disease shall be submitted upon request.

If your appearance has changed, you are required to provide 2 photographs.

                 If you file an application for residence permit for the purpose of employment, you are obliged to submit in addition a document confirming the purpose of your stay, decision on the extension of work permit issued by employment office (in case that you do not need to have work permit, you submit an employment contract). There is no need to submit a document proving sufficient funds to sustain yourself and a travel health insurance policy.

                If you file an application for residence permit for the purpose of business, you are obliged to submit in addition a document issued by the tax office of the CR showing the status of tax arrears and the confirmation from the District Board of Social Insurance that you do not owe any social security contributions or contributions to the state employment policy system, including penalty. (If you are not a payer of such contributions, you are obliged to provide a document evidencing such fact.) In case that you are an entrepreneur according to the Small Business Act, you are obliged to submit a trade certificate or a license deed, or the confirmation from the Trades Licensing Office that you meet the requirements for doing business.

                You attach the same requisites to your application for the extension of residence permit for the purpose of family reunification which you attached to the first application for residence permit for this purpose. There is no need to submit a document evidencing your family relationship.

                You attach the same requisites to the application for the extension of residence permit issued to a resident of another EU member state which you attached to the first application for residence permit for this purpose.

                If you are employed, you are obliged to submit documents which are required in case of applying for the extension of residence permit for the purpose of employment (see above).

                If you do business in the territory, you also shall provide the same requisites as in case of the first application for residence permit for this purpose (see above).

                You attach the same requisites to your application for the extension of residence permit for the purpose of study which you attached to the first application for residence permit for this purpose. There is no need to submit the abstract from Criminal Register and a medical report.

                You attach the same requisites to your application for the extension of residence permit for the purpose of protection in the territory which you attached to the first application.

                You pay administrative fee of CZK 1000,- for the extension of validity. Children below 15 years of age are exempted.
