Residence of an EU Citizen and his/her family members in the CR

                The Aliens Act includes a special provision regulating the residence of EU citizens and their family members. Family members of an EU citizen include: spouse, child below the age of 21 and an unprovided next of kin (child, parent) or a next of kin of the spouse. It is assumed that in future EU citizens and their dependants will be regulated by a different piece of legislation.

                Provisions of the Aliens Act  regarding an EU citizen’s family member analogically relate to a person who lives with an EU citizen in common household (this also applies to registered partnership) or to a person who is not self-sufficient for health reasons and needs personal care (assistance) of an EU citizen, or is a member of the family of a citizen of the Czech Republic.

                If you are staying in the territory of the CR as a dependant of an EU citizen, you cannot be awarded the status of a long term resident.

 

Temporary residence permit

An EU citizen can apply for temporary residence permit, if he/she plans to stay in the CR for a period longer than 3 months and if he/she has not endangered security of the state or has not seriously broken the public peace.

                You are obliged to attach following documents: passport, photographs, document confirming the purpose of your stay, your travel health insurance policy and a document evidencing your lodging in the territory.

                A family member of an EU citizen is entitled to applying for a temporary residence permit under similar conditions. He/she is obliged to attach to the application a document confirming that he/she is a family member of an EU citizen.  Also this document shall be submitted by a family member who is not an EU citizen. If you are an unprovided next of kin, you shall also submit a document confirming that you are such an unprovided person (e.g. medical report or document certifying the status of student).

                Application shall be submitted at the alien police department in the territory.

                You are obliged to submit the application within 3 months from the date of entry in the territory.

                Residence is granted in a form of residence card for a family member of an UE citizen.

 Police can refuse your application for temporary residence e.g. in case that:

-  you have not provided documents required by legislation,

-  there is a reason to believe that you could endanger security of the state or seriously break the public peace,

-   your name is on a list of undesirable persons,

-  you have entered into marriage with the aim to be granted temporary residence permit in the territory (this does not apply to a situation, when a child was born to the married couple or when a child was adopted irrevocably by the couple during the marriage). This ground for refusing the request is taken into consideration only under the condition that a decision to refuse the application would be appropriate in terms of its impact on your personal or family life.

 

Permanent residence permit (family member of an EU citizen who himself/herself is not an EU citizen)

                This type of permit will be issued to you by police upon your request, if:

-   you have been staying in the territory for 5 years without interruption,

-   you are a family member of a citizen of the CR or a family member of a citizen of another EU member state who has been granted permanent residence permit in the territory,

-   you are a survivor of a citizen of the CR or a citizen of another EU member state, who was staying in the territory for the purpose of employment, business or other economic activity, and

-   an EU citizen was staying in the territory at least for 2 years on the date of death,

      -   death of an EU citizen was caused by an occupational injury or an occupational disease, or

      -   if he/she lost his/her citizenship due to entering into marriage with a citizen of another EU member state or due to being awarded his/her citizenship.

Application shall be submitted at the alien police department in the territory of CR.

                Yu are obliged to attach following documents: passport, document confirming that you satisfy one of the above mentioned conditions, 2 photographs and a document evidencing your lodging in the territory.

                In case that you are staying in the territory together with an EU citizen, you are entitled to stay in the territory until the date on which the decision on your application comes into effect.

                Residence permit is granted in a form of card. The card is a separate document by which you prove your identity and basic personal data. The card is issued for the maximum period of 5 years.

                To extend the validity of the card you need to submit a travel health insurance policy (this does not apply to cases when employment, business or other economic activity is the purpose of your stay), 2 photographs and a document confirming that you are staying in the territory together with an EU citizen.
